Scope and Content
Report (3 pages) about Carl Schmitt from the year 1936. The first page of the report is double, the last 3 pages are a copy of the initial report, but with additional handwritten notes, which are faded and unreadable. Content: Schmitt is eliminated from the Academy of German law, he doesn't hold any positions any longer. In the context of the reorganization of the Academy the department "Volk und Reich" was newly founded, but will not be headed by Schmitt, but by SS Standartenführer Stuckart. At the Academy there are only two of Schmitt's followers left, Prof. Weber and Referendar (trainee lawyer) Mutius; the director has already been warned about them. According to newest reports, Schmitt will be excluded from "Nationalsozialistischer Rechtswahrerbund" ("National Socialist Association of German Legal Professionals") in the near future and will have to resign from all posts by 01.01.1937 at the latest. Schmitt is admitting to his close friends that his fight is lost. But he has already new activities, dealing with Law of Nations. On a trip to Rome he became friends with the leader of the Deutscher Akademischer Austauschdienst (German Academic Exchange Service) branch there, [Theodor] Blahut, and with the famous Italian Professor of Law of Nations [Carlo] Costa Magna [Costamagna], who has won Mussolini's favor. [Theodor] Blahut is a catholic and representative of the Catholic Church. Schmitt plans to establish a new Institute of Law of Nations in Rome together with [Carlo] Costa Magna [Costamagna]. To foster this establishment, he wants to visit Mussolini in Rome, supported by his friends [Theodor] Blahut and [Carlo] Costa Magna [Costamagna]. Schmitt's sneaky plan is an attempt to gain influence within a new field after having been eliminated from the domestic national-socialist sphere of law. It is absolutely necessary to stop both the establishment of such an Institute by Schmitt and his trip to Rome.
