Scope and Content
Verdict and explanatory statement of the trial in Bern about the trial about the Wise Men Of Zion. The verdict is a revision of the verdict of the Bern trial from 14.05.35. Schnell and Fischer filed an appeal against the verdict. Their lawyer Ruef cites a number of formal errors in the handling of the protocols of the trial and the handling of the Russian documents and other. The court acquitted both defendants in 1937 on purely formal legal grounds, arguing that the term "Schundliteratur" of the Bernese Law is not applicable to "political publications" but only to "immoral (obscene) publications". The Berner Obergericht refused the obligation of the private plaintiffs to pay the costs of defence of the acquitted defendants.
